As an integral part of the Portal's Terms of Use and Browsing Conditions, this document, called Privacy Policy, aims to establish the rules on obtaining, using and storing data and information collected from visitors, besides registering their activities.

 

1 Definitions

1.1 For purposes of this Privacy Policy, the following definitions apply:

Nuuvem: NUUVEM LTDA., current name of NUUVEM JOGOS DIGITAIS S.A., enrolled in the CNPJ/ME under no. 17.126.332/0001-10, headquartered at Rua Lauro Muller, 116, Sala 503 (part), Botafogo, in the city of Rio de Janeiro/RJ, Zip code 22290-160.

Cookies: Files sent by the Portal server to the Users' computer to identify the computer and obtain access data, such as pages browsed or links clicked, thus allowing the personalization of the Users' browsing on the Portal, according to their profile.

IP: Abbreviation for Internet Protocol. It is a set of characters, often numeric, that identifies the Users' computer on the Internet.

Logs: Records of Users' activities carried out on the Portal.

Portal: Designates the Nuuvem Portal, made available by Nuuvem and accessible to Users through the domain "www.nuuvem.com".

Session ID: Information used to allow access to the Portal.

User(s): Person(s) who have a valid account on the Portal and who access or interact with the activities offered.

Visitor: Everyone who accesses the Portal.

Web beacons: Lines of programming in HTML pages that have the purpose of obtaining details of the User's navigation, such as how long the Portal was open, which address was visited next, among other data.

 

2 Consent

It is based on your consent that we process your personal data. Therefore, consent is the free, informed and unequivocal manifestation by which you authorize NUUVEM to process your data.

Thus, in line with the General Data Protection Law, your data will only be collected, processed and stored with your prior and express consent. 

Your consent will be obtained in a specific way for each purpose described above, evidencing NUUVEM's commitment to transparency and good faith with its users/customers, following the relevant legal regulations.

By using the services of NUUVEM LTDA. and providing your personal data, you are aware and consenting to the provisions of this Privacy Policy, in addition to knowing your rights and how to exercise them.

At any time and without charge, you may revoke your consent.

It is important to point out that the revocation of consent for the treatment of data may imply the impossibility of the proper performance of some site functionality that depends on the operation. Such consequences will be informed in advance. 

 

3 Obtaining data and information

3.1 Data and information will be obtained when the User voluntarily enters information on the Portal, in the interaction with the tools and interfaces of the Users' devices, frequency of access, contact through the available access channels, or through cookies, when Users access the Portal. The data will be obtained with the User's consent.

 

4 Storage of data and information

4.1 All data and information collected from Users will be incorporated into the Portal's database.

4.2 The data and information collected will be stored in a secure environment, observing state of the art.

4.3 What do we do to keep your data secure?

To keep your personal information secure, we use physical, electronic, and managerial tools geared toward protecting your privacy.

We apply these tools taking into consideration the nature of the personal data collected, the context and purpose of the processing, and the risks that possible violations would create to the rights and freedoms of the data subject of the data collected and processed.

Among the measures we have adopted, we highlight the following:

Your personal data is stored in a safe and reliable environment.

Nuuvem is committed to adopting the best postures to avoid security incidents. However, it is necessary to point out that no virtual page is entirely safe and risk-free. It is possible that, despite all of our security protocols, problems that are exclusively the fault of third parties may occur, such as cyber-attacks by hackers or also as a result of the user/customer's own negligence or imprudence.

In case of security incidents that may generate relevant risk or damage to you or any of our users/customers, we will notify those affected and the National Data Protection Authority about the occurrence, in line with the provisions of the General Data Protection Law.

 

5 Use of data and information 

5.1 The data and information collected from Users may be used for the following purposes:

a) Answer eventual User's doubts and requests;

b) Compliance with a legal or judicial order;

c) Constitute, defend, or regularly exercise rights in the judicial or administrative sphere;

d) Ensure the security of Users and administrators;

e) Maintain the Users' records up to date for the purposes of contact by e-mail, telephone, or other means of communication;

f) Enriching the Users' database with the purpose of customizing services, better service, promoting the Portal, and developing new products;

g) Promote the service and its partners, commercial or otherwise, and inform about new opportunities and benefits for the User;

h) Generate analyses and studies, whether statistical or identifiable, based on the behavior of the tool and Portal usage;

i) Improve the use and interactive experience during the User's navigation on the Portal as well as other tools and platforms launched by Nuuvem; 

j) Improve the functioning of the Portal as well as other tools and platforms released by Nuuvem and/or its partners, commercial or not, that are related, directly or indirectly, to the Portal or its environment and proposals; 

k) Verify compliance with the minimum age for purchasing electronic games and other products or services sold through our website.

5.1.1 We may also send data regarding our customer's name, e-mail address and IP address to publishers related to the game purchased by our customer. Publishers are the companies that own the rights to exploit electronic games, like Nintendo, for example.  We will not send this information to publishers unrelated to the game purchased through our platform.

5.2 The database formed by Nuuvem through collecting data from the Portal shall not be sold, assigned, transferred, leased or shared with third parties for purposes not foreseen in this Privacy Policy.

5.3 The use of the database will be restricted to Nuuvem or business partners, respecting the need to which they will be submitted, the relevance to the objectives of the Portal and the interests of the Users, whose privacy will always be preserved.

5.4 If the User stops using the services offered by the Portal, Nuuvem may keep the data for legal purposes or permanently delete them at its convenience, under the terms of the law. To request the closure of the account and consequently the deletion of its data from the platform, the user must send an e-mail to support@nuuvem.com or request it through "Contact Us" in our Help Center https://www.nuuvem.com/support.

5.5 How can you exercise your rights as a holder?

To exercise your rights as a holder, you should contact Nuuvem through the following available means:

In order to guarantee your correct identification as the owner of the personal data you are requesting, we may request documents or other evidence that can prove your identity. In this case, you will be informed in advance.

5.5.1 Nuuvem's data steward is available to respond to any requests related to the General Data Protection Act or this Policy via the e-mail address provided above.

 

6 Activity Log

6.1 Nuuvem may record all activities performed by Users on the Site, using logs, including:

a) User's IP address;

b) Actions made by the User on the Portal;

c) Messages, notices, and documents made available to the User when using the Portal;

d) Tools and functionalities accessed by the User;

e) Dates and times of each action and access to each Portal tool;

f) Information about the device used, operating system version, browser, among other applications and software installed;

g) Session ID, when available; and

h) Other information necessary for its proper authentication.

6.2 The records mentioned in item 6.1 may be used by Nuuvem as evidence in cases of illegal acts or contrary to the Terms of Use or improper changes in its systems and registrations, or actions that may endanger the platform and/or the Portal and its Users.

 

7 Cookies and other data-gathering technologies

7.1 The Portal may use cookies, and Users are responsible for configuring their Internet browser if they wish to block them. In this case, some Portal functionalities may be limited.

7.2 The Portal may also use web beacons to collect behavior data of Users visiting the pages, where the installation of files on the equipment may not be necessary.

7.3 Other technologies may be used to obtain navigation data by the User; however, always respecting the terms of this policy and the User's options regarding its collection and storage.

 

8 General Provisions

8.1 The provisions of this Privacy Policy may be updated or modified at any time, and Users are responsible for checking it whenever they access the Portal.

8.2 Users shall contact in case of any doubt regarding the provisions of this Privacy Policy through the means of communication made available on the Portal.

 

9 Applicable Law and Jurisdiction

9.1 This Privacy Policy will be interpreted under the Brazilian legislation, in the Portuguese language, being elected the Court of the Judicial District of Rio de Janeiro in the State of Rio de Janeiro to settle any dispute, question, or doubt supervening, with express waiver of any other, however privileged it may be. For lawsuits initiated by consumers, the consumer may choose to file the lawsuit in the judicial district of Rio de Janeiro, or in the forum of consumer domicile, under the terms of art. 101 of the Code of Consumer Protection, for actions of civil liability of Nuuvem as a supplier of products and services.
